These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "Customer") and Tryslumberkiddies, governing your access to and use of the website located at www.tryslumberkiddies.com (the "Site"), including all content, features, and services available on or through the Site, as well as any products purchased from our online store.

By visiting the Site, browsing our pages, or completing a purchase, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please discontinue use of the Site immediately.

3. Products and Availability

All products listed on the Site are subject to availability. While we make reasonable efforts to keep product listings and inventory information up to date, availability may change at any time due to supply chain conditions, seasonal demand, manufacturer decisions, or other factors outside our control.

We reserve the right to:

Limit the quantity of any product available for purchase per customer or per order;
Discontinue any product at any time without prior notice;
Refuse or cancel any order for any reason, including but not limited to availability issues, pricing errors, or suspected fraudulent activity;
Modify product specifications, features, materials, colors, dimensions, or packaging at any time without prior notice.

Product images on the Site are provided for illustrative purposes only. While we strive for visual accuracy, actual products may differ slightly in color, texture, or appearance due to screen settings, photography conditions, or manufacturing variations. Such differences do not constitute defects and are not grounds for return or refund.

4. Pricing, Payments, and Order Acceptance

4.1 Pricing

All prices on the Site are displayed in United States Dollars (USD) unless a different currency is selected at checkout. Listed prices reflect the product cost only and do not include shipping fees, handling charges, duties, customs fees, or applicable sales taxes, all of which will be calculated and presented during the checkout process before your order is confirmed.

We reserve the right to adjust product prices at any time without prior notice. Price changes will not apply to orders that have already been confirmed and processed. In the event of a pricing error — whether caused by a technical issue, typographical mistake, or inaccurate supplier data — we reserve the right to cancel or adjust any affected orders. If your order is impacted, we will notify you and provide the option to proceed at the corrected price or receive a full refund.

4.2 Payments

We accept major credit and debit cards, as well as other payment methods displayed during checkout, subject to availability. All transactions are processed by trusted third-party payment providers. We do not store your full payment card details on our servers.

By placing an order, you confirm that you are authorized to use the selected payment method and that you authorize us (or our payment processor) to charge your payment method for the full order total, including product cost, applicable taxes, shipping, and any other fees disclosed at checkout.

4.3 Order Acceptance

An order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline any order at any time after it is received. An order is considered accepted only once it has been shipped and a shipment confirmation with tracking details has been sent to you. If an order is cancelled after payment has been collected, a full refund will be issued to your original payment method.

4.4 Promotional Offers and Discount Codes

We may periodically offer promotional pricing, discount codes, or special deals. Unless stated otherwise, these offers are non-transferable, may not be combined with other promotions, and are valid for a limited time only. We reserve the right to modify or withdraw any promotional offer at any time. Misuse of discount codes — including use of automated tools to generate or exploit codes — may result in order cancellation and account suspension.

5. Shipping and Delivery

5.1 Processing Times

Orders are generally processed within one (1) to three (3) business days following payment confirmation, excluding weekends and U.S. federal holidays. Orders submitted after 2:00 PM EST may not begin processing until the next business day. Processing times may be longer during peak periods, promotional events, or times of high order volume.

5.2 Delivery Timeframes

Standard delivery within the contiguous United States typically takes five (5) to twelve (12) business days from the date of shipment. Delivery to Alaska, Hawaii, U.S. territories, and international destinations may take longer and may incur additional charges. All estimated delivery dates are approximations only and are not guaranteed.

5.3 Shipping Carriers

We ship through reputable third-party carriers and fulfillment partners. Once your order ships, you'll receive a confirmation email with a tracking number and link to monitor your package. Please allow 24–72 hours for tracking information to become active after shipment.

5.4 Risk of Loss

All orders are shipped under a shipment contract. Title and risk of loss transfer to you upon delivery of your package to the carrier. We are not responsible for delays, damage, or loss occurring after the package leaves our fulfillment facility. If your shipment is lost or arrives damaged, please contact our support team and we will assist you in pursuing a carrier claim or finding a suitable resolution.

5.5 International Shipping

For orders delivered outside the United States, you are solely responsible for all customs duties, import taxes, brokerage fees, and any other charges levied by the destination country. These costs are not included in the product price or shipping fee. We are not liable for delays resulting from customs clearance.

6. Returns, Exchanges, and Refunds

6.1 Return Eligibility

We provide a thirty (30) day return window from the date of delivery. To be eligible, returned items must be:

Unused, unwashed, and in their original condition;
Free from damage, stains, odors, or signs of use;
In their original packaging with all tags, labels, and accessories included.

We reserve the right to decline returns that do not meet these requirements, or to issue a partial refund at our discretion if an item is returned in a condition that reduces its resale value.

6.2 Non-Returnable Items

The following items are not eligible for return:

Items designated as "Final Sale" or "Non-Returnable" at the time of purchase;
Personalized, custom-made, or monogrammed products;
Gift cards and digital products;
Items that have been used, altered, washed, or damaged by the customer.

6.3 Return Process

To begin a return, contact our support team at support@tryslumberkiddies.com with your order number and reason for return. We'll provide return instructions and, where applicable, a prepaid return shipping label. Return shipping costs may be deducted from your refund unless the return is due to our error (e.g., wrong item sent, defective product).

6.4 Refund Processing

Once your return is received and reviewed, we'll notify you of the outcome. Approved refunds will be credited to your original payment method within five (5) to ten (10) business days. Your bank or card provider may require additional time to reflect the credit. Shipping costs are non-refundable except where the return results from our error.

6.5 Exchanges

To exchange an item for a different size, color, or style, please reach out to our support team. Exchanges depend on product availability. If the item you're requesting is not available, we will process a refund for the original purchase instead.

7. Accuracy of Information

We take reasonable steps to present accurate product information, including descriptions, specifications, images, pricing, and availability. However, we do not guarantee that all content on the Site is complete, current, reliable, or free from errors.

We reserve the right to correct inaccuracies and update information at any time without prior notice, including corrections to pricing or product details after an order has been placed. Affected orders may be cancelled or adjusted, and where applicable, we will contact you to offer alternatives or a full refund.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRYSLUMBERKIDDIES AND ITS RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES (COLLECTIVELY, THE "COMPANY PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of the Site or any products purchased through the Site; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party rights; or (d) any content or information you submit, post, or transmit through the Site.

10. Intellectual Property

All content on the Site — including but not limited to text, product names, descriptions, graphics, photographs, images, logos, trademarks, service marks, trade dress, icons, scripts, and software (collectively, "Content") — is the exclusive property of Tryslumberkiddies or its licensors and is protected under United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for personal, non-commercial purposes only. You may not:

Reproduce, distribute, modify, display, perform, create derivative works from, republish, download, store, or transmit any Content without our prior written consent;
Use data mining tools, bots, scrapers, or similar technologies on the Site;
Use the Site or its Content for any commercial purpose without express written authorization from us;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Site or its Content.

Unauthorized use of any Content may violate applicable copyright, trademark, and other laws, and may result in civil or criminal penalties.

By submitting reviews, comments, feedback, questions, or other content to the Site (collectively, "User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, display, and distribute your User Content in any media format or channel in connection with the operation and promotion of the Site and our business.

You represent and warrant that your User Content does not infringe any third-party rights and does not contain defamatory, obscene, offensive, or unlawful material. We reserve the right to remove or decline to publish any User Content at our sole discretion and without notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY PARTIES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE RESULTS OBTAINED FROM USE OF THE SITE OR ITS PRODUCTS WILL BE ACCURATE OR RELIABLE.

YOUR USE OF THE SITE AND PURCHASE OF PRODUCTS IS ENTIRELY AT YOUR OWN RISK. NO ORAL OR WRITTEN INFORMATION OR ADVICE OBTAINED FROM US OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY SET FORTH IN THESE TERMS.

15. Dispute Resolution

15.1 Informal Resolution

Before pursuing any formal legal action, you agree to first contact us at support@tryslumberkiddies.com and make a good-faith effort to resolve the dispute informally for a minimum of thirty (30) days. The majority of concerns can be addressed quickly through our support team.

15.2 Binding Arbitration

If informal resolution does not result in a satisfactory outcome, any dispute, controversy, or claim arising out of or relating to these Terms — or their breach, termination, or validity — shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. Arbitration shall take place in Sheridan County, Wyoming, or at another location mutually agreed upon by the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND TRYSLUMBERKIDDIES AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both parties agree otherwise in writing, the arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.

15.4 Small Claims Exception

Notwithstanding the foregoing, either party may pursue an individual claim in small claims court where the dispute falls within that court's jurisdictional limits.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. To the extent that court proceedings are permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts in Sheridan County, Wyoming, and waive any objection to such jurisdiction or venue.

17. Force Majeure

We shall not be liable for any failure or delay in fulfilling our obligations under these Terms where such failure or delay arises from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemics, epidemics, government actions, war, terrorism, trade embargoes, labor disputes, supply chain disruptions, carrier failures, power outages, telecommunications failures, cyberattacks, or other force majeure events.

18. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The affected provision shall be modified to the minimum extent necessary to render it valid and enforceable while preserving the original intent of the parties.

19. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the complete agreement between you and Tryslumberkiddies concerning your use of the Site and supersede all prior or contemporaneous communications, understandings, or agreements — whether oral or written — relating to the Site.

20. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. Any waiver of any provision will only be effective if made in writing and signed by an authorized representative of Tryslumberkiddies.

21. Assignment

You may not assign, delegate, or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may freely assign or transfer these Terms and our associated rights and obligations at any time without restriction or notice to you.

22. Electronic Communications

By using the Site or placing an order, you consent to receiving electronic communications from us, including order confirmations, shipping updates, promotional messages, and other account-related notices. You agree that all agreements, disclosures, and communications provided electronically satisfy any applicable legal requirement that such communications be in writing.

You may opt out of promotional emails at any time by clicking the "unsubscribe" link in any such email or by contacting us at support@tryslumberkiddies.com. Opting out of marketing communications will not affect transactional messages related to your orders.

23. Changes to These Terms

We reserve the right to revise these Terms at any time at our sole discretion. Updates take effect immediately upon being posted to the Site and apply to all subsequent use of the Site. The "Last Updated" date at the top of this page reflects when the Terms were most recently revised.

Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically to stay informed of any updates. If you do not agree with the revised Terms, you must stop using the Site.

24. Loyalty Program Membership

We offer an optional Slumberkiddies Loyalty Program ("Membership"). You are enrolled only if you expressly opt in — by ticking the Loyalty Program box on a product page or applying your personal Loyalty discount code at checkout. Enrollment is never automatic with a regular purchase.

Benefits. Active members receive 30% member pricing on eligible orders placed through our store for as long as the Membership remains active.

Free Trial. Every new Membership begins with a 20-day free trial, starting on the date of the order with which you enrolled. You will not be charged any Membership fee during the trial, and you may cancel during the trial at no cost.

Automatic Billing. When the trial ends, and unless you have cancelled, the payment method you provided at enrollment will be charged the Membership fee of $29.99 USD per month (exclusive of any applicable taxes), recurring every month until you cancel. You authorize these recurring charges when you enroll. We will never charge you more than the stated Membership fee without your express prior consent.

Cancellation. You may cancel your Membership at any time, effective immediately, by any of the following: (a) using your account page; (b) emailing us at support@tryslumberkiddies.com with the name and email address on your order; or (c) calling us at +1 929 248 4275. After cancellation no further Membership fees will be charged. To avoid being billed for an upcoming cycle, cancel before that cycle's billing date; fees already processed are handled in accordance with our Refund Policy.

Disclosure. The trial length, recurring fee, and cancellation methods are also presented at checkout whenever you enroll, and a confirmation is available from our support team at any time.
